Rusk Police Reviewing Allegation of Sexual Misconduct During 2022 DWI Arrest

RUSK, Texas (TXAN 24) — The Rusk Police Department says it is conducting an administrative review after receiving an allegation of sexual misconduct involving one of its officers during a June 20, 2022 Driving While Intoxicated arrest.
According to a statement released by the department through attorney Anthony J. King, the complaint triggered an immediate internal review in accordance with departmental policy and Texas law.
Officials say the review includes a comprehensive examination of evidence connected to the arrest, including body-worn camera footage, in-car dash camera video, incident reports, and related documentation.
The department has also notified the appropriate prosecutorial authority to determine whether a criminal investigation should be pursued alongside the administrative review.
Police say the complainant’s identity will remain confidential because of the sensitive nature of the allegation. The officer identified in the complaint has been notified and is being handled under applicable state law, municipal employment procedures, and internal policy.
The department emphasized that the officer is entitled to due process while the review is ongoing.
Officials added that certain records tied to the case may not be publicly released during the investigation under provisions of the Texas Public Information Act, including sections 552.101 and 552.108 of the Texas Government Code, which allow agencies to withhold some information related to confidential or active investigative materials.
Authorities say the goal of the review is to determine the facts and ensure accountability where appropriate while protecting the rights of everyone involved.
Because the investigation remains active, police say no additional details will be released at this time.
