JUST IN: Smith County Sheriff, Larry Smith, Faces Removal Petition

TYLER, Texas (TXAN 24) — A group of Smith County citizens has filed a petition to remove Sheriff Larry Smith from office, citing official misconduct, incompetence, and ethical violations. Filed under Chapter 87 of the Texas Local Government Code and Article V, Section 24 of the Texas Constitution, the petition demands Smith’s suspension and permanent removal via jury trial.


The petition, submitted February 13, 2025, lay dormant until June 16, when a citation was finally issued and Sheriff Smith was formally served.


Allegations Against Sheriff Smith:


  • Refusal to Enforce Immigration Laws: Smith publicly stated he would not enforce immigration law unless the offense was DWI or more serious — a stance the petition claims violates Texas Government Code § 752.053.

  • Medical Incompetence: The filing cites Smith’s Parkinson’s diagnosis and diabetes-related amputations as disqualifying him from active duty.

  • Campaign Finance Violations: Allegations include failing to file required finance reports and using funds for his wife’s travel.

  • Failure to File Bond: Plaintiffs claim he didn’t submit the public official bond required for his current term.

  • Misuse of Resources: Smith allegedly uses a sworn deputy as his full-time chauffeur due to health limitations.




Judicial Conflict in Question


Judge Austin Reeve Jackson is assigned to the case — but plaintiff Miranda Wilt has filed a motion to recuse him, citing prior warrants he issued against her and an ongoing Facebook connection. Public records show Judge Jackson once personally swore Sheriff Smith into office, raising more conflict-of-interest concerns.



On June 11, Jackson referred a recusal motion in a separate case to the Regional Presiding Judge, prompting speculation he may do the same here.


What’s Next?


Now that the citation has been served, court proceedings are expected to move forward. A ruling on the motion to recuse could determine whether Judge Jackson stays on or the case is reassigned.
