Texas Among Most Expensive States for Divorce as National Costs Climb

TEXAS (TXAN 24) — A new April 2026 report is highlighting the growing financial burden of divorce across the country—with Texas ranking among the more expensive states to legally end a marriage.
According to research from Bogin, Munns & Munns, the average divorce in Texas costs about $15,700, placing it ninth nationwide. Attorney rates in the state average $366 per hour, with court filing fees around $300. Texas follows community property laws, meaning assets are typically split 50/50, which can simplify some cases but doesn’t necessarily lower overall costs.
Nationally, Washington, D.C., ranks as the most expensive place to get divorced, with total costs exceeding $20,000. Delaware, New York, and California also rank ahead of Texas, all with average divorce expenses topping $18,000.
Despite not leading the list, Texas still sits well above the national average, reflecting broader trends of rising legal fees and court-related expenses across the U.S.
The report estimates that 4 in 10 American couples now divorce, making cost a growing concern for families navigating the process. Experts say the figures represent uncontested divorces, meaning cases involving disputes over custody or assets can quickly become far more expensive.
On the lower end, West Virginia ranks as the most affordable state for divorce, with attorney rates under $200 per hour.
